Ellis Jones Says £3m Pension Case Offers ‘Salutary Lesson’

Lawyers in Dorset have hailed the outcome of a ‘highly unusual and complex’ £3m pension settlement in a divorce case – with the ruling underlining the importance of seeking specialist legal and expert advice when dealing with pensions.

The case centred on how much of a pension should be treated as marital, and how best to calculate this.

Pensions specialist and Joint Head of Family at Ellis Jones Solicitors Deborah Leask acted for the wife, with the court ultimately adopting a ‘blended’ approach and concluding that 55% of the pension was marital.
The judge also praised the wife’s legal team as ‘first class’, highlighting the value of experienced representation in complex financial cases.

The case involved a defined benefit pension built largely before the marriage but significantly increased in value during it, after millions were paid in to address a funding deficit. This created a key issue: how should that increase be treated?

Two accepted methods produced dramatically different outcomes. A years of service approach suggested only 14.4% of the pension was marital, while a capital value approach suggested as much as 90.6%. The court ultimately balanced these competing analyses to reach a fair outcome.

The case illustrates how technical and nuanced pension division can be – and how different approaches can lead to vastly different results.

Deborah Leask said: “It is a salutary lesson that pension calculations in defined benefit pensions can produce very different results depending on the methodologies used.

“Calculations provided by pension experts are an important tool, but they do not dictate the outcome. The Judge has a very wide discretion to achieve a fair outcome.”

With limited case law in this area, the decision provides helpful guidance – but also serves as a clear reminder that pensions are often one of the most complex and valuable assets in a divorce.
The case was heard in January of this year and the judgement published on February 3.
